Whether Native Title exists and the Progression to Stage II by the Interdepartmental Working Party and offer of a Western Lands Lease are major hurdles which must be addressed before power to residential claims is considered. Much will hinge upon the outcome of the Wilson V Anderson case expected in the next two months. If it is proven that Native Title does not exist in the Wilson/Anderson case it should also prove that it is removed from residential claims. Progressing a residential claim to the offer of a Western Lands Lease has been a lengthy process. John Kerin compiled a report which made recommendations for the reform of the Western Lands Act. These recommendations have now been released in draft form by Mr Aquilina and will be duly presented for legislation. These two factors appear to be coinciding. Aproximately six years ago a small group of community members formed the Lightning Ridge Community Advisory Committee. This coincided with the claim for Native Title over an area broadly referred to as the Narran-Warranbool Reserve. As the LRMA chose to represent only the interests of miners this gorup felt there may be a need to seek individual representaiton for businesses, residential campdwellers and others who occupy the area. They successfully sought, and received, legal aid funding and engaged Suzannah Sheed and Associates, Shepparton, to represent their interests in the Native Title issue. Legal advice is being sought from Ms Sheed by some who chose to be represented. They are concerned that Native Title is causing protracted delays in the offer of both a Western Lands Lease and possible power to these leases. Should the Anderson/Wilson case fail other options may be pursued and the opportunity may exist for those residential claimholders who choose, to join the group presently being represented. Like most hard hitting issues that affect this community the Black Opal Advocate is at their heart.
