CHANGE TO MINERAL CLAIM CONDITIONS

The LRMA are in the process of negotiating revised claim conditions for Opal Prospecting Areas 1, 2 and 3. The proposed conditions are very similar for those already in place for Opal Prospecting Area 4 but have rolled over much sooner than expected.

The major issue under discussion is not permitting titleholders to erect any temporary dwellings such as tents and caravans on their claims. This is a denial of miners’ basic rights as they should be able to camp on their claim to secure their resource and maximise their working hours. The LRMA is not advocating any permanent camps but some mining areas are a long way from Lightning Ridge and it is not economical or efficient to travel home every day.

Other issues are restricting working hours to between sunrise and sunset; restricting the amount of dirt to backfill holes on a claim to 20 cubic metres per hole (all miners realise this would not be enough); giving protection to other improvements in excess of what is required under the Mining Act and additional paperwork.

Under the new regime miners would be required to complete a Mines Operation Plan and an annual Environmental Management Report quite a bit of paperwork which we see will serve no real purpose.

The Opal Advisory Service starts at 9am and finish at 11am so it is important to get in early so they have enough time to price the stones. The panel will price up to six cut and polished stones per miner. For those people who use the Service please remember to return your feedback cards so the Service can refine their pricing policy.

MINERS CONTRIBUTE TO FIGHTING FUND


Opal miners, LRMA members and non-members are continuing to contribute to a fighting fund and band together to hire legal representation for the Mining Warden’s assessment of compensation for the property ‘Muttabun’.

Thank you to all those people who have contributed to the fund but we need as many miners as possible to help.


The LRMA has incurred substantial legal fees over the past year fighting on behalf of all miners. The first case was the Warden’s determination of an Access Management Plan for ‘Wyoming’ which now sets the benchmark for all future Plans. Part of the Warden’s interpretation is being appealed to the Supreme Court so we are still incurring legal costs, although the Plan remains in place.

This second case is Mr Slack-Smith’s application to have the Mining Warden assess compensation for his property ‘Muttabun’. Once again all miners, whether you have a claim on ‘Muttabun’ or not, will be affected by this determination, as it will set a precedent.

To make a donation of the small amount such as $20 simply come into the LRMA office or mail a cheque. For those claimholders on ‘Muttabun’ who would like the LRMA lawyer to represent them in the Warden’s Court you will need to sign the letter to that affect that we have mailed you and pay your contribution as soon as possible as the Warden will probably hear the matter in August.
