NEW PROCESS FOR THE LAND & ENVIRONMENT COURT
Land & Environment Court’s Commissioner Dixon will be making a presentation on the new court processes that will be used for small scale title matters in the future including the determination of Access Management Plans.

The presentation will be held on the evening of Tuesday 28th April 2015 probably at the Lightning Ridge Bowling Club. Everyone is welcome to attend however you must RSVP by email to lecourt@agd.nsw.gov.au by 24 April 2015 so they have an idea of numbers. We don’t have an exact time yet however if you are interested in attending give the LRMA office a call as we should have the time and venue confirmed soon.

ACCESS PROGRESSING
The Land and Environment Court has commenced the process to determine an Access Management Plan for the property ‘Malabar’. A directions hearing was held last Monday morning by telephone with Commissioner Dixon. Commissioner Dixon advised there would be another telephone hearing on Friday 24th April when she will set a date for the conciliation conference.

Should an agreement not be reached at the conciliation conference the matter will proceed to arbitration to be determined. One of the Land and Environment Court Mining Commissioners will preside over the conciliation and arbitration process.

We are fairly confident the Land Environment Court determinations for the properties ‘Allawah’, ‘Sorrento’ and ‘Muttabun’ will be handed down before the conciliation conference for ‘Malabar’. These determinations will provide the basis for going forward. There is a possibility we may even reach an agreement on an Access Management Plan for ‘Malabar’ prior to the conciliation conference.
