POSITIVE YEAR AHEAD
2015 is shaping up to be a positive year. The number of wholesalers visiting on regular basis has increased dramatically over the past 12 months. Over March there have been around ten buyers visit Lightning Ridge. Once the weather cools down we hope this will translate into increased exploration and flowing on from that increased production. There are not many Opal Prospecting Blocks out at present but it has been unseasonably warm and hopefully this will change after Easter.

Compensation has been resolved going forward, however any miners who have received letters from the Department proposing to cancel their titles due to not having a compensation agreement in the past are urged to respond to the Department in writing. The LRMA is happy to assist any member with their letter.

We are hopeful access will be resolved for many areas over the next six months and we are still awaiting determinations on a number of access management plans from the Land and Environment Court. These determinations should provide a valuable template for future plans.

The Bill that commenced on 1 January 2015 introducing the new compensation regime and reinstating infrastructure levies also introduced a new section into the Land and Environment Court Act 1979. This new section relates to mining matters and includes a mandatory conciliation and arbitration process. In the past a matter before the Court such as a determination for an Access Management Plan would go straight to a hearing of the Land and Environment Court. The new process will mean that the parties go to a conciliation conference before a Court Commissioner. The Land and Environment Court are proposing to hold a seminar on the evening of 29 April 2015 to explain the new processes. We will give more details closer to the time.
